Can My Husband and I Use the Same Attorney for Our Illinois Divorce?

Working Within the Rules of Ethics in St. Charles, Elgin, and Throughout the Northern Illinois Area

While it may seem easier and less expensive to use one attorney for your divorce, it is a violation of the Illinois Rules of Professional Conduct for one lawyer or law firm to represent both parties in a divorce. This is because representing both spouses results in a conflict of interests for the attorney.

When you are pursuing a divorce, you and your spouse are likely to look for any way possible to streamline the process and to save money along the way. Divorce can be challenging and costly, and eliminating unnecessary expenses is not an unreasonable goal. Often, a prospective client will arrive at our office for his or her initial consultation accompanied by his or her spouse. At Pucci Pirtle, we recognize that cooperation is the key to a faster, cost-effective divorce, but our firm cannot officially represent both spouses in a divorce matter.

Elgin and St. Charles, IL Lawyers

In a divorce, each spouse is considered an opposing party. It is impossible for one lawyer or law firm to truly act in the best interests of both spouses at the same time. It may be possible, however, for our firm to represent you while your spouse officially represents himself or herself pro se—meaning without an attorney—throughout the process.

If you and your spouse are able to work together in this way, Pucci Pirtle can help you complete your divorce without the need for a second attorney. It is important to remember that your spouse has the right to retain separate counsel at any time and is encouraged to so whenever he or she feels that is necessary.
